London - A team of lawyers from global law firm K&L Gates LLP is advising Norwegian wind farm and renewable energy developer NBT AS and its Ukrainian subsidiary SyvashEnergoProm LLC on the development, construction and financing of a power generation facility and new substation for the 250 MW Syvash Wind Power Project in Kherson Oblast, southern Ukraine.
This includes SyvashEnergoProm LLC’s recent signing of a €292 million engineering, procurement and construction (EPC) Contract with Power Construction Corporation of China, Ltd. (POWERCHINA) and POWERCHINA Fujian Engineering Co. Ltd., who together will serve as the EPC contractor for the wind farm project. Nordex Energy GmbH will act as turbine supplier for the project as well as service provider under a 15-year Warranty Service and Maintenance Agreement to be signed in early September. The signing of the EPC Contract will be marked by a ceremony at the office of the President of Ukraine in Kyiv on 6 September 2018.
An important milestone for the Syvash Wind Power Project, the EPC Contract is the latest in a series of matters on which K&L Gates has advised NBT AS. The firm also represented the company on structuring its renewable energy investment in Ukraine and its acquisition of the Ukrainian wind farm business SyvashEnergoProm LLC earlier this year, in addition to representing NBT AS on the ongoing development, construction and financing of the Syvash Wind Power Project, including equity investment and structuring. JP Morgan is the arranger for the financing of the project, which is scheduled to reach first financial close in October.
London special counsel Alex Blomfield leads the K&L Gates team that advises NBT AS and SyvashEnergoProm LLC on the development, construction and financing of the project, including the EPC Contract.
