In his function as the insolvency administrator, Mr. Stephan Ammann from PLUTA Rechtsanwalts GmbH has sold the brewery of Bürgerbräu Wolnzach AG to Urban Chestnut Brewing Company. The buyer who originates from the German region of Upper Bavaria has been living in the US for several years, where he successfully operates two breweries.
The purchase agreement was concluded with effect from 1 January 2015. The parties have agreed to maintain strict silence on the purchase price.
Bürgerbräu Wolnzach AG had to declare bankruptcy in July 2014. The local court of Ingolstadt had ordered preliminary insolvency administration at the end of July and had opened insolvency proceedings in September. In the meantime, the PLUTA partner Ammann, acting as the insolvency administrator, maintained the brewery’s business and conducted negotiations with several prospective purchasers.
“We are pleased about the successful conclusion of the negotiations. By selling the company to this person, who maintains a strong attachment to his home country, we were able to achieve the best possible solution for both the brewery and the creditors,” said the insolvency administrator Mr. Ammann.
The purchaser took over the brewery’s business operations and also entered into a tenancy agreement with the landlord. This means that the Wolnzach marketplace, which is home to the German Hop Museum, will continue to have a brewery in the future.
The small brewery of the insolvent Bürgerbräu AG had no longer brewed any beer recently. However, as the company’s warehouse was well-stocked, the insolvency administrator was able to continue the selling of beer.
