Norton Rose Fulbright has advised EN GAS & OIL TRADING ITALY S.r.l. in the preparation of a debt restructuring plan and a “concordato preventivo” (agreement with creditors) under art. 161 of the Italian Bankruptcy Code. The plan and proposed agreement with creditors was presented to the Bankruptcy Section of the Court of Rome, which issued a decree on November 20, 2013 stating that the Company was admitted to the relevant concordato preventivo procedure. This proceeding is substantially a restructuring instrument concerning an agreement with the creditors, reached through the vote of the creditors by way of a plan filed by the debtor, under the control of the relevant bankruptcy court.
