Norton Rose Fulbright represents BTMU in acquisition financing for Fiera Axium Infrastructure

Norton Rose Fulbright represented The Bank of Tokyo-Mitsubishi UFJ, Ltd. ("BTMU") in a $33.1 million loan to a subsidiary of Fiera Axium Infrastructure US L.P.

The loan allowed Fiera Axium Infrastructure to acquire a 49% equity interest in the Wheat Field Wind Farm, a 97 MW wind farm owned by EDP Renewables North America LLC.

The wind farm is located on nearly 8,500 acres of cultivated wheat fields in Oregon. Construction began in 2008 and commercial operation was achieved in 2009.  The facility is fully contracted under a 20-year power purchase agreement with Public Utility District No. 1 of Snohomish County, Washington.

Fiera Axium Infrastructure is an open-ended infrastructure fund focused on direct investment in both operational and greenfield development opportunities. It seeks to invest in core energy, transportation and social infrastructure assets across the United States.

The team, led by New York partners Mark Tibberts and Mike Pikiel, included Washington, DC lawyers Becky Limmer and Etienne Toussaint.

Other team members included New York tax partner David Gillespie; Houston ERISA partner Stephanie Schroepfer; New York bankruptcy partner David Rosenzweig; DC energy regulatory senior counsels Mike Rustum and Jeff Williamson; and Los Angeles real estate senior counsel Robert Barnes.
