Insolvency administrator Mr Ivo-Meinert Willrodt from PLUTA Rechtsanwalts GmbH has achieved an investor solution for Straubinger Metallbau GmbH. The acquisition took the form of restructuring by way of an asset transfer with effect as of today. The company’s name will be preserved. It has been agreed that the purchase price will not be published. 18 employees will be kept on.
The future managing directors are Bartholomäus Simbürger, who established the company and managed it until 2013, and Michael Holzbauer. “During the process to search for an investor, there were several interested parties, but finally Mr Simbürger was able to prevail. I am delighted to say that we can ensure a smooth transition for the customers. Mr Simbürger has many years of experience in this sector. The fact that he will once more be at the helm in future is an extremely positive signal for staff and customers alike,” PLUTA attorney Willrodt explained. In tax and legal matters, Mr Simbürger was represented by the tax consultant and auditor Dr. Bernd Waffler and the attorney Dr. Florian Maier from the Straubing branch office of MTG business law firm.
Today, the local court decided to appoint the provisional insolvency administrator, Mr Ivo-Meinert Willrodt, as the official insolvency administrator. Now that the asset transfer has taken place, the company will be able to make a new start outside of the insolvency proceedings, and Mr Willrodt will monitor the remaining steps in the proceedings up to completion.
